Roamavo Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the Roamavo website, platform, checkout, account dashboard, eSIM services, support services, and any related products or services we provide (together, the “Services”).

The Services are operated by Roamavo LLC (“Roamavo,” “we,” “us,” or “our”), a United States limited liability company.

By accessing our website, creating an account, purchasing an eSIM data plan, using an eSIM, using your Roamavo dashboard, or otherwise using our Services, you agree to these Terms. If you do not agree to these Terms, you must not use our Services.

These Terms include important information about eSIM compatibility, activation, refunds, service limitations, acceptable use, account security, payments, chargebacks, and your responsibilities as a customer.


1. About Roamavo

Roamavo provides prepaid travel eSIM data plans for international travelers. Our Services allow customers to purchase digital eSIM data plans for supported destinations and receive eSIM installation details digitally.

Roamavo is not a mobile network operator. We work with third-party eSIM providers, telecommunications providers, network operators, payment processors, fraud-prevention providers, and technology partners to deliver our Services.

Network access, coverage, speed, availability, and performance depend on third-party mobile networks in the destination country or region. Roamavo does not own or control those networks.


2. Definitions

For these Terms:

Account means a customer profile created on Roamavo using email, password, social login, or another authentication method we support.

Data Plan means a prepaid mobile data package purchased through Roamavo for a specific destination, region, or supported coverage area.

eSIM means an embedded SIM profile that can be installed on a compatible device without using a physical SIM card.

Installation Details means the QR code, activation code, SM-DP+ address, manual activation details, or other instructions provided for installing an eSIM.

Activation means the point at which an eSIM or Data Plan becomes active according to the plan rules. Depending on the plan, activation may occur when the eSIM is installed, when it first connects to a supported network, or as otherwise described at checkout or in the plan information.

Top-Up means an additional data plan or package added to an existing eligible eSIM, if supported.

Supported Device means a device that supports eSIM technology, is not carrier-locked, and is compatible with the networks and eSIM profile required for the purchased plan.


3. Eligibility

You may use Roamavo only if you are legally able to enter into a binding agreement and use the Services in accordance with these Terms and applicable laws.

If you use Roamavo on behalf of a company or another legal entity, you confirm that you have authority to accept these Terms on behalf of that entity.

You may not use Roamavo if:

  1. You are prohibited from using the Services under applicable laws.
  2. You are located in a country or region where we do not offer the Services.
  3. You are using the Services for fraud, abuse, resale without permission, network misuse, or any prohibited activity described in these Terms.

We may refuse service, suspend an account, cancel an order, or limit access where required by law, by our partners, or where we reasonably suspect fraud, abuse, or violation of these Terms.


4. Your Account

You may need an Account to purchase, access, manage, install, top up, or view your eSIM.

You agree to provide accurate and current information when creating an Account or placing an order. You are responsible for keeping your login credentials secure.

You are responsible for all activity that occurs through your Account unless the activity results from our own security failure.

You must notify us immediately if you believe your Account has been accessed without permission.

We may suspend, restrict, or terminate your Account if:

  1. You breach these Terms.
  2. We suspect unauthorized, fraudulent, abusive, or illegal activity.
  3. Your payment is disputed, reversed, cancelled, or reported as unauthorized.
  4. Required identity, payment, or security checks cannot be completed.
  5. We are required to do so by law, regulation, payment processor, provider, or network partner.

If your Account is suspended or terminated due to a violation of these Terms, you may not be eligible for a refund.


5. eSIM Compatibility

Before purchasing, you are responsible for confirming that your device:

  1. Supports eSIM technology.
  2. Is not carrier-locked or network-locked.
  3. Supports the destination networks required by the selected Data Plan.
  4. Is running software that allows eSIM installation and mobile data use.
  5. Has not reached the maximum number of eSIM profiles allowed by the device.
  6. Is not restricted by your current carrier, device manufacturer, country settings, or operating system configuration.

Roamavo may provide compatibility guidance, device lists, FAQs, or help articles, but these are informational only. Device manufacturers, carriers, and operating systems may change compatibility rules, device behavior, or settings without notice.

If your device is not eSIM-compatible or is carrier-locked, the eSIM may not install or work. Refund eligibility in this situation is described in the Refund Policy section below.


6. Plan Information and Coverage

Each Data Plan may include information such as:

  1. Destination or coverage area.
  2. Data allowance.
  3. Validity period.
  4. Price.
  5. Supported network operators.
  6. Estimated network type such as 4G, LTE, or 5G.
  7. Hotspot/tethering availability.
  8. Top-up availability.
  9. Activation rules.
  10. Installation or unused validity period.
  11. Any fair usage, speed reduction, or throttling conditions.

Plan information is provided based on data from Roamavo, our providers, and network partners. We try to keep plan information accurate, but coverage, operators, network availability, data speeds, plan availability, and prices may change.

We may update, replace, remove, or deactivate plans at any time.

A plan shown as available on our website is subject to final confirmation at checkout and provider availability during fulfillment.


7. Data-Only Service

Unless clearly stated otherwise, Roamavo eSIM plans are data-only.

This means they usually do not include:

  1. Traditional voice calls.
  2. SMS text messages.
  3. A local phone number.
  4. Emergency calling.
  5. Carrier billing.
  6. Premium SMS or paid telecommunication services.

You may still be able to use internet-based communication apps such as WhatsApp, iMessage, FaceTime, Telegram, Messenger, Skype, Zoom, Google Maps, email, and other data-based services, subject to app availability, local laws, network quality, and your device settings.

Roamavo is not responsible for app-specific issues, blocked services, local restrictions, VoIP limitations, or problems caused by third-party applications.


8. Purchase and Order Process

When you purchase a Data Plan, you must provide accurate information and complete payment through the available checkout options.

After payment is confirmed, we will attempt to provision and deliver the eSIM or Installation Details digitally through your Account dashboard, email, or another delivery method shown at checkout.

Most eSIMs are delivered quickly, but delivery may be delayed due to:

  1. Payment review.
  2. Fraud checks.
  3. Provider delays.
  4. Network or API downtime.
  5. Incorrect customer information.
  6. Technical errors.
  7. Manual review.
  8. High-risk or suspicious order activity.

We reserve the right to cancel or manually review any order before delivery.

If we cannot deliver an order after payment has been successfully captured, we will either provide a replacement, issue a refund, or contact you for additional information.


9. Digital Delivery

Roamavo provides digital products. No physical SIM card will be shipped.

Delivery is usually made by one or more of the following:

  1. Account dashboard.
  2. Email.
  3. QR code.
  4. Manual activation code.
  5. Installation guide.
  6. In-app or web-based instructions.

You are responsible for ensuring that your email address is correct and that you can access your Roamavo Account.

You should check your spam, promotions, or junk folder if you do not receive an email.

Failure to read or follow installation instructions may result in installation problems and may affect refund eligibility.


10. Installation and Activation

You are responsible for installing the eSIM correctly according to the provided instructions.

Important installation rules:

  1. Do not delete the eSIM after installation unless instructed by Roamavo support.
  2. Do not attempt to install the same eSIM on multiple devices unless we clearly state that this is supported.
  3. Do not scan the QR code with the same device on which you need to install the eSIM unless your device supports that flow.
  4. Install the eSIM only on the intended compatible device.
  5. Keep your primary SIM settings, roaming settings, APN settings, and mobile data settings configured correctly.
  6. Follow destination-specific activation instructions.

Some eSIMs can be installed before travel and activate only when they connect to a supported network. Other eSIMs may start their validity period upon installation. You must read the activation policy shown for your plan.

If a plan has an installation or unused-validity deadline, you must install or activate the eSIM before that deadline. After the deadline passes, the eSIM or Data Plan may expire, become unavailable, or no longer be eligible for refund or replacement.


11. Validity Period

The validity period is the period during which the Data Plan can be used.

Depending on the plan, the validity period may start:

  1. When the eSIM is installed.
  2. When the eSIM first connects to a supported network.
  3. On a selected start date.
  4. Immediately after purchase.
  5. According to another activation rule shown on the plan or checkout page.

You are responsible for checking the activation rule before purchasing and before installing the eSIM.

Once the validity period begins, it cannot usually be paused, restarted, extended, transferred, or reset unless the plan supports top-ups or extensions.

Unused data normally expires at the end of the validity period.


12. Unused Validity and Installation Deadline

Some eSIMs or Data Plans may have an unused validity period or installation deadline after purchase or issuance.

If you do not install or activate the eSIM before that deadline, the eSIM or Data Plan may expire and may no longer be usable.

Roamavo may show an “Install by” or similar deadline in your Account dashboard where available. This is provided based on provider data and may be subject to provider rules.

If you fail to install or activate the eSIM before the applicable deadline, you may need to purchase a new plan.

Refund eligibility after missing an installation or unused-validity deadline is described in the Refund Policy section below.


13. Network Coverage and Speed

Roamavo provides access to mobile data through third-party networks. We do not guarantee uninterrupted coverage, specific speeds, 5G availability, LTE availability, latency, signal strength, or availability in every location.

Network quality may vary based on:

  1. Destination country or region.
  2. Local operator coverage.
  3. Network congestion.
  4. Weather or environmental conditions.
  5. Buildings, tunnels, rural areas, mountains, airports, ships, or border zones.
  6. Device compatibility.
  7. Device bands and frequency support.
  8. Local laws or network restrictions.
  9. Carrier roaming agreements.
  10. Maintenance or outages.

Plan pages may show supported network operators or network types, but these may change. “5G,” “4G,” or “LTE” availability does not mean those speeds are guaranteed everywhere.


14. Fair Usage and Unlimited Plans

If Roamavo offers unlimited or high-data plans, those plans may be subject to fair usage policies, speed reductions, throttling, daily limits, network management, or provider restrictions.

Where applicable, fair usage terms will be shown on the plan page, checkout page, or help article.

Unlimited data does not always mean unlimited high-speed data. After a usage threshold, speed may be reduced for the rest of the day, validity period, or another period determined by the provider or network operator.

Roamavo is not responsible for speed reductions, throttling, or network management applied by local network operators or upstream providers where disclosed or required by the plan rules.


15. Top-Ups

Some eSIMs may support top-ups. Top-up availability depends on the specific eSIM, original plan, provider rules, destination, and status of the eSIM.

Top-ups may not be available for every plan or destination.

A top-up may be unavailable if:

  1. The original eSIM has expired.
  2. The plan does not support top-up.
  3. No compatible top-up package exists.
  4. The provider has withdrawn the plan.
  5. The eSIM was deleted, transferred, or otherwise cannot be identified.
  6. The customer used a different device or account in a way that prevents top-up.

Where top-up is available, Roamavo may show compatible top-up options in your dashboard. The price, data amount, validity, and activation rules of the top-up may differ from the original plan.

If top-up is not available, you may need to purchase a new eSIM or new Data Plan.


16. Prices, Taxes, and Currency

All plans are prepaid. You pay at the time of purchase.

Prices are shown in the currency displayed at checkout. We may support multiple currencies at our discretion.

Prices may change at any time before purchase. The price charged is the price shown at checkout when you complete your order, unless there is an obvious pricing error.

Taxes may be included in the displayed price or calculated separately at checkout depending on your location, billing information, applicable laws, and payment processor settings.

You are responsible for any taxes, duties, foreign exchange fees, bank charges, card issuer fees, or other charges imposed by your bank, card issuer, payment provider, or local authorities.

Roamavo is not responsible for foreign exchange fees or additional charges applied by your bank or payment provider.


17. Payment

We may accept payment by card, digital wallet, account credit, promotional credit, or other payment methods shown at checkout.

By submitting payment information, you confirm that:

  1. You are authorized to use the payment method.
  2. The payment information is accurate.
  3. You authorize us and our payment processors to charge the amount shown at checkout.
  4. You authorize fraud checks, payment verification, and security review.

Payment processing is handled by third-party payment processors. We do not control all aspects of payment authorization, payment decline reasons, charge timing, bank fees, or card issuer decisions.

We may refuse, cancel, or delay an order if payment fails, payment is disputed, fraud is suspected, or additional verification is required.


18. Promotions, Discounts, Credits, and Coupons

Roamavo may offer discounts, promo codes, referral credits, store credits, or other promotional offers.

Promotions are subject to the terms shown with the offer and may be changed, suspended, or ended at any time.

Unless we state otherwise:

  1. Promo codes cannot be exchanged for cash.
  2. Promo codes cannot be sold or transferred.
  3. Promo codes cannot be combined with other offers.
  4. Promo codes may expire.
  5. Promo codes may apply only to selected destinations, plans, users, or purchase amounts.
  6. Promo codes may be limited to one use per customer.
  7. Credits may be deducted or cancelled if the related order is refunded, reversed, disputed, or found to be fraudulent.

We may refuse or cancel promotions where we suspect abuse, duplicate accounts, self-referrals, fraud, or violation of these Terms.


19. Refund Policy

This section explains when refunds may be available.

Because Roamavo sells digital prepaid eSIM data plans that may be delivered instantly, refund eligibility depends on the status of the eSIM, whether it has been installed or activated, whether data has been used, the reason for the request, the timing of the request, and whether you cooperated with troubleshooting.

19.1 Refund request deadline

Unless a longer period is required by applicable law, refund requests must be submitted within 30 days of purchase or within 30 days of the issue giving rise to the request, whichever is earlier.

Requests submitted after the applicable deadline may be denied.

19.2 Full refund for unused and non-activated plans

You may be eligible for a full refund if:

  1. The eSIM has not been installed; or
  2. The eSIM has been installed but the Data Plan has not been activated; and
  3. No data has been used; and
  4. The refund request is submitted within 30 days of purchase; and
  5. The order is not suspected of fraud, abuse, or violation of these Terms.

19.3 Full refund for incompatible or carrier-locked device

You may be eligible for a full refund if you cannot install or use the eSIM because your device is not eSIM-compatible or is carrier-locked, provided that:

  1. No data has been used.
  2. The request is submitted within 30 days of purchase.
  3. You cooperate with support and provide requested screenshots or device information.
  4. The eSIM has not been misused, transferred, or installed on another device.

You are responsible for checking device compatibility before purchase. We may deny repeated refund requests based on incompatible or locked devices if we believe the policy is being abused.

19.4 Refund or replacement for Roamavo-side or provider-side service issue

If you activated a Data Plan but cannot use it due to an error, omission, or service issue on Roamavo’s side or our provider’s side, we may provide a replacement or refund.

To qualify:

  1. You must contact support within 30 days of the issue.
  2. You must cooperate with troubleshooting.
  3. You must provide requested screenshots, device settings, error messages, location details, or other reasonable information.
  4. You must not delete the eSIM unless instructed by support.
  5. We must be unable to restore your ability to use the plan within a reasonable troubleshooting period.

If a replacement plan solves the issue, a refund may not be provided.

19.5 Partial refunds for partially used plans

If your plan has been activated and some data has been used, a full refund is not guaranteed.

We may consider a partial refund if:

  1. The issue was caused by Roamavo, our provider, or a network service issue not caused by you.
  2. A meaningful portion of the data remains unused.
  3. You submit the request within 30 days of the issue.
  4. You cooperate with troubleshooting.
  5. The plan has not expired.
  6. The issue could not be reasonably resolved.

Any partial refund may be based on the unused portion of the plan, the reduction in value, the duration of the issue, data used, provider rules, payment processing fees, and other relevant factors.

19.6 Minimal usage

If an activated plan has been used only minimally, Roamavo may, at its discretion, consider a full or partial refund depending on the circumstances.

Minimal usage does not automatically guarantee a refund.

19.7 No refund situations

Unless required by applicable law, you will not be entitled to a refund in the following situations:

  1. You used a significant portion of the data.
  2. The plan expired.
  3. The installation or unused-validity deadline passed.
  4. Your trip was cancelled after the plan was activated or data was used.
  5. You changed your mind after activating or using the plan.
  6. You purchased the wrong destination, region, plan, or data amount and then activated or used it.
  7. You deleted the eSIM and we can no longer troubleshoot or verify the issue.
  8. You attempted to install the eSIM on an unsupported, locked, rooted, jailbroken, modified, restricted, or incompatible device.
  9. You refused to cooperate with troubleshooting.
  10. You did not contact support within the required period.
  11. The issue was caused by incorrect device settings, disabled roaming, disabled data, incorrect APN settings, local restrictions, app-specific issues, or failure to follow instructions.
  12. The issue was caused by poor coverage in a specific indoor, rural, remote, underground, maritime, aviation, or border location where network availability is limited.
  13. You violated these Terms or our Acceptable Use rules.
  14. The purchase is associated with fraud, abuse, unauthorized payment, chargeback misuse, or suspicious activity.
  15. You created multiple accounts to abuse promotions, credits, refunds, or referral programs.

19.8 Refund method and timing

Approved refunds are usually issued to the original payment method.

At our discretion, and where allowed by law, we may offer account credit, store credit, or replacement service instead of or in addition to a refund.

Refunds to cards or payment methods may take up to 30 business days to appear, depending on banks and payment processors.

Payment processing fees, foreign exchange fees, bank fees, or card issuer fees may not be refundable.

19.9 How to request a refund

To request a refund, contact Roamavo support at: support@roamavo.com

Please include:

  1. Your order number.
  2. The email address used for purchase.
  3. Destination and plan purchased.
  4. Device model.
  5. Description of the issue.
  6. Screenshots of device settings or error messages if relevant.
  7. Confirmation of whether the eSIM was installed, activated, or used.

We may ask for additional information before making a decision.


20. Chargebacks and Payment Disputes

If you have a problem with your order, you should contact Roamavo support before filing a chargeback or payment dispute.

If you file a chargeback or dispute, we may suspend your Account, pause support, cancel pending orders, disable credits, or restrict access while the dispute is reviewed.

We reserve the right to provide evidence to the payment processor, including order details, delivery records, eSIM status, data usage, IP logs, support communication, refund policy acceptance, and account activity.

If a chargeback is found to be fraudulent or abusive, we may terminate your Account and refuse future service.


21. Support

Roamavo provides customer support through the support channels shown on our website or dashboard.

Support may include help with:

  1. Installation.
  2. Activation.
  3. Device settings.
  4. APN settings.
  5. Data roaming settings.
  6. Network selection.
  7. Dashboard access.
  8. Order status.
  9. Refund requests.
  10. Top-up availability.

Support response times may vary based on volume, time zone, complexity, provider response times, and third-party outages.

You agree to cooperate with reasonable support requests. Failure to provide requested information may affect our ability to help and may affect refund eligibility.


22. Acceptable Use Policy

You agree not to use the Services for any unlawful, harmful, abusive, fraudulent, or unauthorized purpose.

You must not use the Services to:

  1. Violate any law, regulation, court order, or government requirement.
  2. Commit fraud or identity theft.
  3. Send spam, phishing, malware, viruses, or harmful content.
  4. Abuse networks, systems, APIs, promotions, referrals, or refunds.
  5. Resell, rent, share, distribute, or commercially exploit the Services without written permission.
  6. Use automated systems, bots, scripts, or scraping tools against our platform without permission.
  7. Interfere with network security or platform security.
  8. Attempt unauthorized access to accounts, systems, APIs, payment systems, or customer data.
  9. Circumvent usage limits, plan restrictions, speed limits, throttling, compatibility requirements, or fraud checks.
  10. Use the Services in a way that damages Roamavo, our providers, network operators, payment processors, or other customers.
  11. Use the Services for unusually high, abusive, or non-personal traffic inconsistent with normal travel data usage.
  12. Use the Services for permanent fixed broadband replacement unless the plan clearly allows that use.
  13. Use the Services in sanctioned or restricted countries where prohibited by law or by our partners.

We may suspend, restrict, terminate, throttle, or refuse service if we believe this Acceptable Use Policy has been violated.


23. Fraud Prevention and Security Reviews

We may use fraud-prevention tools, payment verification, device information, IP information, order history, account activity, and third-party services to detect suspicious activity.

We may delay or cancel an order if:

  1. Payment appears suspicious.
  2. Billing information cannot be verified.
  3. The order appears inconsistent with normal customer use.
  4. Multiple accounts, devices, cards, or identities appear connected.
  5. A payment processor flags the transaction.
  6. The order violates provider restrictions.
  7. Additional verification is required.

We are not responsible for losses caused by order delay or cancellation due to reasonable fraud prevention, security review, or compliance requirements.


24. Third-Party Providers and Services

Roamavo relies on third-party providers, including but not limited to:

  1. eSIM providers.
  2. Mobile network operators.
  3. Roaming partners.
  4. Payment processors.
  5. Fraud-prevention providers.
  6. Email providers.
  7. Authentication providers.
  8. Hosting and infrastructure providers.
  9. Analytics and customer support tools.

Your use of Roamavo may involve third-party terms, privacy policies, technical rules, network restrictions, and service limitations.

We are not responsible for third-party outages, network failures, provider API failures, payment processor decisions, bank delays, device manufacturer restrictions, app-store rules, or mobile operator limitations outside our reasonable control.


25. Account Credits and Rewards

Roamavo may offer account credit, wallet balance, referral rewards, promotional credits, or similar benefits.

Unless we state otherwise:

  1. Credits have no cash value.
  2. Credits cannot be withdrawn.
  3. Credits cannot be sold or transferred.
  4. Credits may expire.
  5. Credits may be limited to certain plans or destinations.
  6. Credits may be removed if obtained through abuse, fraud, duplicate accounts, or violation of these Terms.
  7. Credits related to a refunded order may be deducted or cancelled.
  8. Credits are not property and do not create a bank account, stored-value account, or payment account.

We may change, suspend, or discontinue credit or reward programs at any time, subject to applicable law.


26. Referrals and Affiliate Offers

If Roamavo offers referral or affiliate programs, participation is subject to the program rules shown at the time.

You may not:

  1. Refer yourself.
  2. Create fake accounts.
  3. Use misleading advertising.
  4. Spam referral links.
  5. Use paid ads that impersonate Roamavo.
  6. Misrepresent discounts or offers.
  7. Abuse coupon codes or promotional systems.
  8. Claim commissions for fraudulent, refunded, reversed, or disputed orders.

We may cancel rewards, deny commissions, close accounts, or remove credits if referral or affiliate activity is abusive, misleading, fraudulent, or contrary to program rules.


27. Intellectual Property

The Roamavo website, brand, logo, design, software, content, graphics, icons, text, images, code, user interface, and related materials are owned by Roamavo or licensed to us.

You may use the Services only for their intended purpose.

You may not copy, modify, distribute, sell, rent, reverse engineer, scrape, reproduce, or create derivative works from our website, software, content, branding, or Services without our written permission.

All trademarks, service marks, logos, and brand names remain the property of their respective owners.


28. User Content and Feedback

If you submit reviews, feedback, suggestions, support messages, ideas, or other content to Roamavo, you grant us permission to use that content to operate, improve, support, market, and develop our Services.

You confirm that your content does not violate the rights of others and is not illegal, abusive, defamatory, misleading, or harmful.

We may remove or refuse to display user content at our discretion.

If you send ideas or suggestions, you agree that we may use them without compensation or obligation to you.


29. Privacy

Your use of Roamavo is also governed by our Privacy Policy.

The Privacy Policy explains how we collect, use, store, share, and protect personal information.

You should read the Privacy Policy before using the Services.

If you do not agree with our Privacy Policy, you should not use Roamavo.


30. Electronic Communications

By using Roamavo, creating an Account, or making a purchase, you agree to receive electronic communications from us, including:

  1. Order confirmations.
  2. eSIM delivery messages.
  3. Login or verification emails.
  4. Security alerts.
  5. Payment receipts.
  6. Refund updates.
  7. Support messages.
  8. Service notices.
  9. Policy updates.

You may unsubscribe from marketing emails, but you may still receive transactional, security, legal, and service-related emails.


31. Service Availability

We aim to keep Roamavo available, but we do not guarantee uninterrupted or error-free access.

The Services may be unavailable due to:

  1. Maintenance.
  2. Updates.
  3. Hosting issues.
  4. Provider outages.
  5. Payment processor outages.
  6. Network failures.
  7. Cyberattacks.
  8. Force majeure events.
  9. Legal or compliance restrictions.
  10. Third-party service failures.

We may modify, suspend, or discontinue any part of the Services at any time.


32. No Guarantee of Continuous Connectivity

Roamavo provides travel data plans through third-party networks and providers. We do not guarantee that the Services will be uninterrupted, available everywhere, or free from delays, errors, coverage gaps, speed changes, throttling, or network restrictions.

You should not rely on Roamavo as your only method of communication in emergencies.

Roamavo eSIMs may not support emergency calls or SMS. Always keep an alternative means of communication where safety is important.


33. Customer Responsibilities

You are responsible for:

  1. Choosing the correct destination and plan.
  2. Checking device compatibility.
  3. Confirming your device is unlocked.
  4. Installing the eSIM correctly.
  5. Following activation instructions.

  13. Using the Services in a lawful and reasonable manner.

34. Limitation of Liability

To the maximum extent permitted by law, Roamavo and its owners, directors, officers, employees, contractors, affiliates, providers, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of data, loss of business, travel disruption, missed flights, missed bookings, lost opportunities, additional roaming charges, alternative connectivity costs, or other losses arising from your use of or inability to use the Services.

To the maximum extent permitted by law, Roamavo’s total liability for any claim related to the Services will not exceed the amount you paid to Roamavo for the specific Data Plan giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.


35. Disclaimer of Warranties

The Services are provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, Roamavo disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, network coverage, speed, uninterrupted service, compatibility, and error-free operation.

We do not guarantee that:

  1. The Services will work on every device.
  2. Network coverage will be available everywhere.
  3. Speeds will meet your expectations.
  4. The Services will be uninterrupted.
  5. Third-party networks will always be available.
  6. A specific local network will be available at all times.
  7. A plan will remain available for future purchase or top-up.

36. Indemnification

You agree to defend, indemnify, and hold harmless Roamavo and its owners, directors, officers, employees, contractors, affiliates, providers, and partners from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising from:

  1. Your use or misuse of the Services.
  2. Your violation of these Terms.
  3. Your violation of law.
  4. Your violation of third-party rights.
  5. Fraudulent, abusive, or unauthorized activity through your Account.
  6. Chargebacks, disputes, or claims caused by your actions.
  7. Your failure to check compatibility or follow instructions.
  8. Your resale or unauthorized commercial use of the Services.

37. Changes to the Services

We may update, improve, modify, suspend, or discontinue any part of the Services at any time.

We may change:

  2. Prices.
  3. Destinations.
  4. Coverage areas.
  5. Network operators.
  6. Top-up availability.
  7. Account features.

If a change materially affects an active paid plan, we will try to provide a reasonable solution, replacement, or refund where required by these Terms or applicable law.

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law rules, unless applicable consumer protection laws require otherwise.

If you are a consumer located in a jurisdiction with mandatory consumer rights, nothing in these Terms limits rights that cannot be waived under applicable law.


40. Dispute Resolution

Before starting any formal dispute, you agree to contact us first at support@roamavo.com and give us a reasonable opportunity to resolve the issue.

Most issues can be resolved through support, replacement, account credit, refund review, or troubleshooting.

If a dispute cannot be resolved informally, the dispute will be handled according to the laws and courts applicable under the Governing Law section, unless mandatory consumer laws provide otherwise.


41. Consumer Rights

Nothing in these Terms limits any mandatory consumer rights that apply to you under the laws of your country or region.

Where you are legally entitled to a withdrawal period, refund, repair, replacement, or other consumer remedy that cannot be excluded, those rights will apply.

Because Roamavo provides digital services that may be delivered and activated quickly, your right to cancel or withdraw may end once the eSIM is delivered, installed, activated, or used, depending on applicable law.


42. Force Majeure

Roamavo will not be responsible for failure or delay caused by events outside our reasonable control, including:

  1. Natural disasters.
  2. War, terrorism, civil unrest, or government action.
  3. Network outages.
  4. Mobile operator failures.
  5. Provider outages.
  6. Payment processor outages.
  7. Internet failures.
  8. Cyberattacks.
  9. Labor disputes.
  10. Regulatory changes.
  11. Travel restrictions.
  12. Power failures.
  13. App store or platform restrictions.
  14. Other events beyond our reasonable control.

43. Assignment

You may not assign or transfer your rights or obligations under these Terms without our written permission.

Roamavo may assign or transfer these Terms in connection with a merger, acquisition, sale of assets, reorganization, change of control, or transfer of business operations.


44. Severability

If any part of these Terms is found to be invalid, unlawful, or unenforceable, the remaining parts will remain in effect.

The invalid or unenforceable part will be interpreted as closely as possible to the original intent in a lawful and enforceable way.


45. No Waiver

If we do not enforce a provision of these Terms, that does not mean we waive our right to enforce it later.

Any waiver must be in writing and signed by Roamavo.


46. Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, Cookie Policy, plan details, checkout terms, and any additional terms shown at purchase, form the entire agreement between you and Roamavo regarding the Services.

If there is a conflict between these Terms and specific plan details shown at checkout, the checkout details will apply to that specific purchase only.
